Are there time limits for an unfair dismissal claim?
Yes, most claims have time limits. If you have been dismissed, you only have 21 days to lodge a claim. It is very difficult to get this time limit extended so it is best to seek advice straight away.
What evidence might be required for an unfair dismissal claim?
For all claims, written evidence is the best form of evidence. For example, emails, letters, records of meetings or text messages. Statements from witnesses are also very useful. If the claim relates to wages, then you will need payslips or proof of your earnings and what you have worked.
If you believe there is an issue with your pay, we recommend keeping a record of what you have been working, patricianly if you are not receiving payslips (even though this is a legal requirement).
Can I bring an unfair dismissal claim if I am on WorkCover?
Yes you can. Our employment lawyer also practices in the WorkCover field and will be able to assist and provide you with advice in relation to this.
How much are your fees?
